You may be entitled to compensation if you have suffered domestic abuse

Domestic abuse can have a devastating impact on victims and their families.

Many people are unaware that compensation may be available through the Criminal Injuries Compensation Authority (CICA) where they have suffered physical or psychological injuries as a result of domestic abuse.

If you have been subjected to violence, coercive behaviour, sexual abuse or other forms of domestic abuse, you may be entitled to make a claim.

Our team understands the sensitive nature of these cases and will handle your claim with compassion, understanding and confidentiality.

Can I Claim Compensation For Domestic Abuse?

You may be able to claim compensation if you suffered a physical injury or recognised psychological injury as a result of domestic abuse.

Compensation may be available for:

• Physical injuries

• Anxiety

• Depression

• Post Traumatic Stress Disorder (PTSD)

• Other recognised psychological injuries

Every claim is assessed on its individual circumstances.

Does The Abuse Need To Have Been Reported To The Police?

In most cases, the CICA expects incidents to have been reported to the police. However, domestic abuse cases are often complex. Many victims do not feel able to report abuse immediately due to fear, coercion or concerns for their safety. The CICA recognises these difficulties and each case is considered on its own facts. If you are unsure whether your circumstances may affect your claim, our team can advise you.

What If The Abuse Happened Years Ago?

Many victims do not come forward until years after the abuse occurred. This is particularly common where victims have experienced long-term coercive control, psychological abuse or fear of repercussions.Whilst time limits apply to CICA claims, extensions can often be considered where there are exceptional circumstances. It is important not to assume that a claim cannot proceed simply because the abuse happened some time ago.

Do I Need A Conviction?

No. Compensation may still be available even where:

• Nobody has been convicted

• Criminal proceedings were not pursued

• The offender denied the allegations

As long as you have cooperated with the police investigation and there is sufficient evidence to support the claim, compensation may still be available.

Will I Need To Attend Court?

In most cases, no.

CICA claims are usually dealt with directly by the Criminal Injuries Compensation Authority.

In some circumstances a tribunal may be required if a decision is disputed. If this happens, we can advise and represent you throughout the process.

Many claims are resolved without the need for victims to attend a hearing.
